Terms and conditions

1. Claims

In the event of accidents, the Customer undertakes to protect the interests of Moto Officina Coluccio and undertakes, among other things:

• to provide the names and addresses of the parties involved in the accident and witnesses,
• not to admit any liability of which he is not certain,
• not to leave the vehicle unattended and without adequate protection,
• to immediately inform the Moto Officina Coluccio Saverio of the accident by telephone and to report it within 3 days using the duly signed cid form,
• to inform the police authorities in case of need and in case of injuries.

In the event of a passive accident, the costs of roadside assistance and recovery of the vehicle are the responsibility of the customer.

2. Repairs and Assistance

For any repair, the Customer will be required to pay any sums to the Moto Officina Coluccio Saverio.

3. Administrative Fines and Tolls

The Customer undertakes to notify Moto Officina Coluccio Saverio of the disputes for violations of the Cds or other legislation committed during the rental and to immediately transmit any report notified to him. Failing this, the Customer will be liable for any damage directly or indirectly caused by the omission. With the exception of cases in which the violation is exclusively attributable to Moto officina Coluccio Saverio, the Customer will be directly liable to the authorities that imposed the fine and undertakes to pay or reimburse the amounts relating to unpaid motorway tolls and pecuniary administrative sanctions imposed, plus any costs of notification of the various communications.

4. Jurisdiction

For any dispute that may arise in the interpretation and / or execution of this contract, the competent court will be that of Messina.

5. Return of the vehicle

The Customer undertakes to return the vehicle on the date indicated in the contract in the same conditions in which he received it, except for normal wear and tear in relation to the km travelled.

6. Disclaimer

The Customer acknowledges that La Moto Officina Coluccio Saverio can never be held responsible for loss or damage to people and things transported, abandoned or forgotten on the vehicle both during the rental and after the return, or for damage or inconvenience resulting from delay in delivery , from breakdowns or from any other cause. In the event that vehicle breakdowns should occur during the rental period, the Moto Officina Coluccio Saverio will not be responsible for damages of any nature, contractual or non-contractual, suffered by the customer.

7. Resolution

Pursuant to and for the purposes of art. 1456 code civ. the non-fulfillment by the customer of even one of the obligations to which he is bound under this contract entails the legal termination of the contract itself

8. Privacy

The data provided by the Customer may be processed within the limits permitted by the law on the protection of personal and sensitive data, in compliance with the principles of security and confidentiality. In particular, the data may be used by the Moto Officina Coluccio Saverio in order to allow the public authorities to forward the related complaints to the customer responsible for violations of the highway code or other legislation.
